Navigating the employment tribunal process

  1. Acas Early Conciliation: Before a claim can be issued, you are required to contact Acas (Advisory, Conciliation and Arbitration Services) for early conciliation. We can prepare and submit the Acas notification on your behalf and attempt to reach a resolution settlement without the need for formal proceedings.
  2. The ET1 Claim Form: If early conciliation does not resolve the issue, the next step is to submit an ET1 claim form to the Employment Tribunal. We can advise on time limits, identify the most appropriate legal claims and draft and submit your ET1 claim form, clearly presenting facts and the relevant heads of claim.
  3. The ET3 Form: your employer responds to the ET1 using the ET3 form, outlining their defence. We can review the employer’s ET3 response for weaknesses/inconsistencies, advise on evidence and witnesses needed to strengthen your claim and discuss strategy for next steps.
  4. Preliminary Hearings: the Tribunal may hold preliminary hearings to deal with procedural issues and case management directions. We can assist with preparing legal submissions and legal arguments for preliminary hearings, advise on procedural rights and obligations, and instruct counsel to attend preliminary hearings where appropriate.
  5. Disclosure & Witness Statements: both parties exchange evidence and witness statements in preparation for the final merit hearing. We can assist with gathering relevant documents and drafting and reviewing witness statements to ensure they are clear, accurate and comply with Tribunal directions.
  6. Pre-Trial Preparation: before the final hearing, we can assist with reviewing and analysing the employer’s evidence to identify weaknesses, ensuring a final bundle includes all relevant documents relied upon and strategize the presentation of your claim. We can also instruct counsel to attend the final merit hearing, ensuring specialist advocacy.  
  7. Tribunal Hearing: the final hearing is where both parties present their evidence and arguments before an Employment Tribunal. We can attend alongside counsel (if required) to provide support and guidance to you. During the final hearing, we liaise closely with counsel to ensure the claim strategy is followed and that all evidence is presented clearly and accurately. 
  8. Tribunal Decision and Remedies: after the hearing, the tribunal issues a decision. We can review and explain the tribunal decision and advise on options moving forward.
  9. Appeals: each party may appeal a tribunal decision, but appeals are strictly limited to certain grounds. We can assess whether your case has valid grounds for appeal, advise on prospects of success and draft and submit appeal documents to the Employment Appeal Tribunal (EAT).
