An LPA is a legal document that allows you to appoint one or more trusted people (your “attorneys”) to make decisions on your behalf should you lose the capacity to make those decisions yourself. There are two types of LPA:
- Health and Welfare – covering decisions about medical care, where you live, and your day-to-day wellbeing.
- Property and Financial Affairs – covering decisions about managing your money, paying bills, selling property, and dealing with banks.
So, why is making an LPA so beneficial?
Peace of Mind for You and Your Loved Ones
Putting an LPA in place means that, if the unexpected happens, your loved ones will have clear authority to step in and help manage your affairs without delay. It removes uncertainty and ensures your wishes are respected.
Avoiding Court Delays and Costs
If you lose capacity and have not made an LPA, your family will need to apply to the Court of Protection to be appointed as a deputy. This process is time-consuming, expensive, and can cause unnecessary stress at an already difficult time.
You Stay in Control
You choose who to appoint as your attorney(s), and you can set out specific instructions or preferences for how you’d like them to act. This means you’re still in control of future decisions, even if you're unable to make them yourself.
Flexibility and Tailored to Your Needs
An LPA can be tailored to suit your specific situation. You can appoint multiple attorneys, choose how they make decisions (jointly or individually), and include guidance to reflect your personal values and beliefs.
It’s Not Just for the Elderly
Loss of capacity can happen to anyone, at any age – due to illness, accident, or injury. An LPA is a sensible precaution for all adults, not just those in later life.
Helps with Everyday Practicalities
Having a Property & Financial LPA in place can allow your attorney to deal with banks, utility companies, and manage ongoing bills if you are unwell or abroad – even temporarily. It’s incredibly useful for continuity and stability.
