In order to protect employees’ terms and conditions in the event of a business, or part of a business, being bought or sold, or in the event of services being outsourced or insourced, the Transfer of Undertakings (Protection of Employment) Regulations – often referred to as TUPE-may apply.

TUPE is designed to protect transferring employees’ employment and ensure that their terms and conditions are maintained. 

TUPE and its application is notoriously tricky for employers to navigate and failure to comply with an employer’s statutory obligations can have serious repercussions.
